Kratom is legal. But is it safe?

Schlesinger Law Offices is investigating claims involving concentrated kratom extracts and 7-hydroxymitragynine  (commonly called 7-OH).  

There is growing concern that certain manufacturers and sellers failed to adequately warn consumers that their products could cause addiction, severe withdrawal, respiratory depression, seizures, liver injury, and death. 

Kratom is often marketed as a natural wellness product, energy or focus aid, pain reliever, or an opioid alternative without clearly communicating the potential risks. Its widespread availability in gas stations, convenience stores, smoke shops, and online can make it seem like an ordinary retail product, even though regular use may carry risks of addiction, dependence, overdose, and other serious health complications.

Do I qualify for a kratom lawsuit?

What are Kratom and 7-OH?

Kratom is a drug derived from the leaves of the Mitragyna speciosa tree. It contains psychoactive compounds, including mitragynine and 7-hydroxymitragynine, which can both produce stimulant and opioid-like effects.  

In the United States, kratom is sold as powders, capsules, teas, extracts, and liquids. More recently, concentrated 7-OH products have been sold as tablets, gummies, drink mixes, and shots. 

In 2025, the FDA recommended that certain concentrated 7-OH products be controlled under the federal Controlled Substances Act.  

In 2026, the DEA announced plans to temporarily classify certain high-strength 7-OH products as Schedule I controlled substances, the same federal category that includes heroin and Ecstasy.

What Injuries can Kratom and 7-OH Cause?

Along with addiction and withdrawal symptoms, serious health effects include: 

Respiratory Depression and Cardiac Events: High-potency products may cause severe sedation, respiratory failure, loss of consciousness, or cardiac arrest. 

Liver Injury: Kratom has been associated with drug-induced liver injury, jaundice, hepatitis and, in severe cases, liver failure. 

Seizures: Poison-control reports and medical literature have associated kratom exposure with seizures, with some resulting in brain injury. 

Wrongful Death: Kratom and 7-OH have been identified in fatal overdose investigations. In some cases, medical examiners have identified kratom or mitragynine as a cause or contributing cause of death.
