Attorney Jonathan Gdanski of Schlesinger Law Offices, P.A. in Fort Lauderdale has landed a $1 million verdict for a medical malpractice client. The lawsuit was filed against Palm Beach Gardens Medical Center after his client — Kenneth Kunhardt — after it was discovered that the tip of a catheter and a ruptured medical balloon were left inside his chest cavity. The medical devices were left inside of his body after the Medical Center failed to complete an angioplasty.
Kunhardt suffered a heart attack in 2013 and required double bypass surgery. The doctor performing the bypass discovered the leftover medical devices during the procedure. It is believed the heart attack may have been triggered, worsened, or made more likely due to the foreign objects.
Palm Beach Gardens Medical Center is attempting to escape the full $1 million verdict by asking a Circuit Judge to lessen the amount, or to order a retrial. The defendants claim the amount should be reduced to reflect what Kunhardt had to pay out of his own pocket. They also want Kunhardt to pay for the defendant’s attorney fees for not accepting a settlement and taking the case the court.
Despite the opposition’s persistence, Attorney Gdanski is optimistic about the developing case. He noted in an article with The Palm Beach Post that seven-figure medical malpractice verdicts are rare, especially in Palm Beach County. With the impressive initial victory already secured, he is confident they will be able to prevail, and they may even be able to secure additional damages related to court costs, like expert witnesses.
