The U.S. Food and Drug Administration has recently authorized the sale of the first non-tobacco, non-menthol flavored vape products in the United States. This authorization does not mean the FDA considers these products safe. It simply means that the FDA concluded that these particular vape products provided enough potential benefit to adult smokers to justify the risk to younger people.
The authorization, announced on May 5, 2026, included four newly authorized vape products, including two fruit flavors (blueberry and mango). The decision is controversial because it marks a significant FDA policy shift involving products that appeal strongly to underage users. Reports also suggest that this move by the FDA may have contributed to the departure of former FDA Commissioner Marty Makary.
Does the flavor of vapes really matter?
Numerous studies show how non-tobacco flavors are more popular with kids and lead to increased use.

What was the FDA’s previous stance on fruit flavors?
Up until this decision, the FDA had not approved any fruit flavored vape products.
- “The agency has issued […] orders for 41 e-cigarette products to date, all of which are tobacco- or menthol-flavored. This is despite the FDA receiving millions of applications, most of which have been for flavors other than tobacco or menthol. How does age-verification technology work for vapes?
Another controversial aspect of this announcement is the description of the new Bluetooth age-gating system included in these products. New technology is being used as an attempt to prevent underage use. In practice, however, the effectiveness is not yet known.
- “The technology requires the user to verify their age and identity with a government-issued ID and pair the device with a smartphone via Bluetooth. Following verification, the device will not operate if separated from the phone.
