Making the Threat of Trial Clear in Insurance Litigation

As the years have gone on, insurance litigation has started to look more and more like a “game of chicken” – at least according to plaintiffs’ attorneys and insurance companies. In a recent article titled ‘The Whites of Their Eyes’: When Litigating Against Insurers Becomes a Game of Chicken, author Raychel Lean at Law.com explores why this has become the norm – and in her article, our trial attorney Bryan Hofeld was asked to share his thoughts on the matter.

Noting that insurers have a vested interest in reducing their exposure to liability, Hofeld says that the only way to respond to that is to make the possibility of a jury trial seem as real as possible. “They’ve got to know that you are a lawyer who is perfectly willing and able to try your case if necessary… Because at the end of the day, they know that they’re going to have to be reasonable and fair with you.”
