Justice Delivered: $2.3M Verdict for a South Florida Motorcycle Accident Victim

Motorcycle POV on a long straight road

The Problem

When an insurer refuses to pay fair compensation to accident victims, the only path to justice is a jury trial. In this case, we took a motorcycle accident case to court in Broward County, the jury returned a $2.3 million verdict, recognizing the full scope of the injuries to our client and what he will need to move forward.

According to Scott Schlesinger, “Sometimes the only way to achieve justice is to go to trial and let a jury decide. The insurance company in this case refused to offer a fair settlement, so our client placed his trust in a jury of South Floridians, and they delivered a fair and just verdict.”

The Accident

On February 27, 2022, our client Dayron Arguelles, a 57-year-old hairstylist from Aventura, was stopped in traffic on I-95 South when a driver in a rental Volvo SUV failed to see the stopped vehicles and rear-ended him, launching him more than 30 feet. The defendant accepted full responsibility for causing the crash.

The Injuries

Mr. Arguelles suffered fractures to both the tibia and fibula and a traumatic brain injury that still affects his daily life. For someone who stands for long hours and relies on precise motor skills, these injuries are devastating, impacting his work, his health, and his independence.

The Trial

The case was tried before Judge Daniel Casey in Broward County. Liability was conceded, but the defense disputed the extent of the injuries and the damages. Our trial plan was straightforward: present a complete record of current medical bills, future care needs, and pain and suffering so the jury could return an informed verdict.

The Verdict

The jury awarded $2.3 million to compensate Mr. Arguelles including past and future medical expenses and losses beyond medical bills, such as pain, mental anguish, and diminished enjoyment of life. The verdict reflects the severity and lasting impact of his injuries and provides for the care he will need going forward.

The Team

Our trial team: Scott Schlesinger, Sarah Foster, and Gloria Contreras-Piana, made sure the jury understood the full scope of our client’s injuries and the strength it took for him to keep going. We’re proud of this outcome and grateful for the jury’s careful consideration of the evidence.
