A family represented by the Schlesinger Law Offices in ongoing litigation over toxic baby formula manufactured by Abbott Laboratories was recently featured in an article published by Bloomberg.

The article chronicles the series of missteps and misconduct that took place at an Abbott Laboratories’ plant in Sturgis, Michigan, where an FDA investigation in September 2021 found evidence of Cronobacter sakazakii, a bacteria that can survive for months or years and cause devastating illness in infants, in powdered formula and how that discovery led to a sweeping recall and production shutdown that created an extreme nationwide baby formula shortage.

The article also tells the story of Owen Bayer, who contracted meningitis when he was 5 months old, and the harrowing trauma endured by his parents Jordyn and Zach, who watched as their child struggled in a St. Louis hospital before suffering a seizure, being intubated, and rushed into a helicopter so he could be airlifted to a larger medical facility.

After learning about Abbott’s recall, Owen’s parents brought several cans of recalled formula from their home to the Missouri Department of Health and Senior Services for testing. A copy of the lab report confirming the presence of Cronobacter sakazakii in an open can of Similac Pro-Sensitive formula was provided to Bloomberg by Schlesinger Law Offices and included in the article.

While Owen is now at home, he is not out of the clear. As Owen’s mother Jordyn told Bloomberg, Owen may suffer from a range of disabilities and delays due to his infection.

“He could have mental delays, physical delays, learning disabilities, things that we’re not going to know for a while. We’re just supposed to be on the lookout. So, I’m always asking myself: ‘Is that normal?”
